กฎหมายในงานออกแบบภูมิสถาปัตยกรรม

Abstract

งานภูมิสถาปัตยกรรมนั้นมีความหลากหลายในแง่ของรายละเอียดของเนื้องานที่มีความแตกต่างกันตั้งแต่งานขนาดเล็กจนถึงงานที่มีขนาดใหญ่ ปัจจัยสำคัญประการหนึ่งที่เกี่ยวข้องในงานออกแบบดังกล่าวคือ กฎหมายสำหรับงานภูมิสถาปัตยกรรม ซึ่งมีความจำเป็นอย่างยิ่งและผู้ออกแบบจำเป็นต้องมีความรู้และความเข้าใจในเนื้อหาของกฎหมายนั้นเพื่อมาประกอบการออกแบบ ในปัจจุบันมีกฎหมายที่บังคับใช้ใหม่เกิดขึ้นอยู่เสมอ แต่กฎหมายหรือข้อบังคับใช้เหล่านี้ยังไม่มีความชัดเจนมากนักสำหรับงานด้านภูมิสถาปัตยกรรม แต่จะแทรกอยู่ในเนื้อหาของกฎหมายที่บังคับใช้ในงานออกแบบทางสถาปัตยกรรมทั่วไปเสียเป็นส่วนใหญ่ งานศึกษาค้นคว้านี้มีวัตถุประสงค์เพื่อรวบรวมกฎหมายที่เกี่ยวข้องกับงานภูมิสถาปัตยกรรม เพื่อทราบให้ถึงปัญหาในการใช้กฎหมายที่เกี่ยวข้องกับงานภูมิสถาปัตยกรรมที่นำมาประกอบการออกแบบ เพื่อให้สามารถนำข้อกฎหมายดังกล่าวไปใช้ในงานออกแบบภูมิสถาปัตยกรรมได้สะดวกและมีความเข้าใจมากขึ้น โดยศึกษาและรวบรวมข้อมูลจากแหล่งต่างๆ ทำให้ได้ผลวิจัยที่แสดงให้เห็นว่า กฎหมายในงานออกแบบภูมิสถาปัตยกรรมนั้นมีหลากหลายรูปแบบซึ่งขึ้นอยู่กับลักษณะของงาน ที่ตั้งโครงการ และหน่วยงานที่เกี่ยวข้องกับงานโครงการนั้น ๆ ทราบถึงรายละเอียดของกฎหมายที่เกี่ยวข้อง รวมถึงปัญหาและอุปสรรคในการนำกฎหมายมาใช้ในงานออกแบบหรือไม่ ซึ่งพบว่าหากผู้ออกแบบมีความรู้ความเข้าใจในกฎหมายที่เกี่ยวข้องกับงานออกแบบทางภูมิสถาปัตยกรรมไม่ดีพอ จะส่งผลให้งานออกแบบตั้งแต่กระบวนการเริ่มต้นทั้งด้านการเสนอโครงการเพื่อการก่อสร้าง การออกแบบที่เป็นไปตามความถูกต้องตามกฎหมายหรือไม่ หรือแม้กระทั่งบทลงโทษที่จะส่งผลเสียต่อตัวผู้ออกแบบโดยตรง รวมไปถึงเนื้องานและเจ้าของโครงการอีกด้วย ตลอดจนด้านระยะเวลาและค่าใช้จ่ายที่ต้องเพิ่มขึ้น แม้กระทั่งผลกระทบต่อพื้นที่โดยรอบโครงการด้วยเช่นเดียวกัน Landscape architecture design is diverse in terms of details of each work, ranging from small to large scales. The significant factor for the design is the law of landscape architecture which is essential and designers need to understand the law in order to design their work properly. At present, there are many newly-emerging laws; however, these laws or regulations are not clear for landscape architecture, but are mostly inserted in the content of general architecture laws. This study aims to collect the laws related to landscape architecture in order to learn about problems and challenges in enforcing landscape architecture laws into the work of landscape architecture, so that landscape architecture - related laws will be put into practice in a more convenient and more understanding manner. The study results were derived from information gathering and demonstrated that there are various forms of landscape architecture laws depending on the nature of work, project sites, and whether or not related agencies involved in the projects know about laws relevant to their work. Moreover, problems and obstacles in enforcing the laws into the design of work are that if designers do not or little understand landscape architecture - related laws, this will affect almost the whole process in designing, namely project construction presentation, legitimate or illegitimate design or even legal punishment that will adversely and directly affect the designers, the work, and the project owners, the time duration, and the increasing costs or even the impacts on surrounding areas.
